I boarded the city-bound 86 tram believing my myki was in positive balance. I always keep it topped up. When a tapped on I discovered it would not validate. I was about to disembark the tram at the next stop so I could top up my myki and make good for the fare, however I was stopped by Authorised Officers who checked my card and fined me.
On the day of the alleged offence, I boarded the 59 tram at stop 31 and touched on my myki. I was with a friend who also touched on at the same machine; we both heard the machine beep and assumed we had successfully validated our myki cards. Two or three stops later, Authorised Officers boarded the tram. An Authorised Officer checked my myki card and advised it had not been validated. Upon explaining that I had touched on when boarding the tram, I was advised I should request a review of the infringement, explaining the circumstances.
I am new to Melbourne, when I arrived I was told to buy a myki card and top it up with some money. When I went to the shop, I asked the shop keeper how much money I should put on the card. I am completely unfamiliar with Melbourne, the distances and the cost of travel. I trusted the advice of the shop-keeper when he told me $20 would be enough for a week. I am living in Dandenong and travel to and from university every day. When I got on the bus, I didn't recognise the sound that the myki reader made was the sound of a declined card. I thought I had validated my ticket. When the Authorised Officers boarded the bus and checked my myki, they told me it had a negative balance. I tried to explain, but they issued me a fine. If I could have, I would have topped up the myki, but they would't let me.
I am an international student living on my own. I am very new to Melbourne and I am still getting used to the public transport system here. I did not know I needed to touch on when I got on a tram.
I had an exam that day and I was very stressed and preoccupied. I suffer from anxiety and so I was unable to concentrate on my surroundings and did not touch on. I have attached a letter from my counsellor explaining this.

I boarded the tram at at Stop 38 in Maribynong road and there is nowhere to buy or top up a myki card. I am very new to Melbourne and I did not know I could not purchase a ticket on the tram. At the Showgrounds stop, Authorised Officers boarded the tram and asked to see my myki card. I explained that I have just arrived in Melbourne and I did not yet have one. I explained I didn't know how to buy a myki card, and I thought I could purchase a ticket on the tram. I cried but the Authorised Officers still issued me an infringement.
