For whatever reason, you may have ignored or not received the original infringement and the reminder notices. After the final date to pay the fine has passed, the matter is referred to the Infringements Court and is no longer subject to an internal review or referral to the Magistrates' Court. The Infringements Court will most likely issue an Enforcement Order which requires you to pay both the original fine plus administrative costs. You must pay the full amount ordered or else the Court may issue an infringement warrant which empowers the Sherrif to come and seize your property to pay the debt and even arrest you in certain circumstances. For this reason is is critical you do not ignore an Enforcement Order.
However, in certain circumstances if you can establish the relevant grounds, the Infringements Court has the power to "revoke" (cancel) an enforcement order (and any infringement warrant). This means that the enforcement order is cancelled. However once the Sheriff has already seized your property or you have been arrested it is no longer possible to have the order revoked.
To apply for revocation of the enforcement order you must complete an application form and file it with the Infringements Court. The application must address the grounds for seeking the revocation. What can I say in the application for revocation?
If the Infringement Court grants the application, the enforcement order is effectively cancelled. The matter is then referred to the Magistrates' Court for hearing and determination unless the organisation that issued the fine asks the Court not to do so (in which case the fine is effectively withdrawn and the matter is concluded).
If the Court refuses the application, you may apply to the Court to refer the matter to the Magistrates' Court for hearing and determination. To do this you must file an Objection with the court by the date specified in the court’s letter, otherwise the Sheriff will execute the infringement warrant unless you comply with the Enforcement Order.
